1. Object

1.1 These General Terms and Conditions of Online Sale, together with the order form, privacy policy, cookie policy, and other elements provided on this website, are intended to regulate the terms and conditions governing purchases made through the Online Store www.aleo-cosmetica.com.

1.2 The online store is operated by Aleo Cosmética, Lda. (hereinafter “Aleo Cosmética”), a legal entity under Portuguese law, with corporate tax identification number (NIPC) 516 577 670 and registered office at Rua 9 de Dezembro, nº 47, 4820-161 Fafe, Portugal.

1.3 Aleo Cosmética, Lda. is the owner of the registered trademark “Aleo Cosmética”.

1.4 Placing any order through the online store implies the full reading, understanding, and acceptance of these General Terms and Conditions of Online Sale.

1.5 These conditions apply exclusively to consumers, defined as any natural person acting for purposes that fall outside the scope of their commercial, industrial, craft, or professional activity.

2. Marketed Products

2.1 The online store www.aleo-cosmetica.com commercializes: cosmetic products, hygiene products, cleansing creams, moisturizing creams, baby and children’s items, promotional packs, textiles, and accessories, and may also sell other products.

2.2 All marketed products comply, where legally applicable, with the European and national regulations in force regarding their category.

2.3 Products must be used in accordance with the instructions on the packaging, labeling, and manufacturer’s recommendations.

2.4 In case of doubt regarding use on newborns, babies, or children with sensitive skin, prior medical or pharmaceutical advice is recommended.

3. Product Information, Prices, and Content

3.1 Aleo Cosmética reserves the right to change, at any time and without prior notice, product prices, promotional campaigns, descriptions, images, availability, and commercial terms of sale.

3.2 The images displayed on the website are purely illustrative and may show minor differences relative to the product actually delivered, namely regarding packaging, colors, sizes, or graphics.

3.3 The prices shown include VAT at the legal rate in force, unless expressly stated otherwise.

3.4 In the event of a manifest pricing error, IT error, or obvious oversight, the order may be canceled prior to shipment, and the customer will be promptly informed and fully reimbursed for any amount already paid.

3.5 Unless out of stock, the products displayed are presumed to be available.

4. Registration and Customer Account

4.1 Purchases may be made through:

  • The creation of a customer account; or

  • Guest checkout, when this feature is available.

4.2 The customer guarantees that all data provided is true, complete, and up to date.

4.3 Aleo Cosmética is not responsible for delays or failures resulting from incorrect or incomplete data provided by the customer.

5. Order Process

5.1 The customer must select the desired products and add them to the shopping cart.

5.2 Before completing the order, the customer must confirm:

  • Selected products;

  • Quantities;

  • Delivery address;

  • Billing details;

  • Shipping costs;

  • Payment method.

5.3 The final submission of the order corresponds to a contractual purchase proposal.

5.4 Upon receipt of the order, an automatic confirmation email will be sent.

5.5 The order is only considered definitively accepted after payment validation and stock availability.

6. Payments

6.1 The following payment methods may be available, among others:

  • MB WAY;

  • Multibanco Reference;

  • Bank transfer;

  • Apple Pay;

  • Google Pay;

  • Other methods presented at checkout.

6.2 Aleo Cosmética reserves the right to limit certain payment methods depending on the country of destination, order value, or security criteria.

6.3 All transactions are processed by specialized third-party entities.

7. Deliveries and Shipping

7.1 Orders may be shipped to Portugal and other countries available at checkout.

7.2 The company may use third-party carriers, namely DPD or other equivalent entities.

7.3 Delivery times are merely indicative and depend on external logistical factors.

7.4 Aleo Cosmética is not responsible for delays attributable to:

  • Carriers;

  • Incorrect addresses;

  • Absence of the recipient;

  • Customs;

  • Strikes;

  • Force majeure events;

  • Unforeseeable events.

7.5 Risk transfers to the consumer at the moment of delivery.

7.6 It is recommended that the packaging be checked at the time of delivery.

8. Shipping Costs

8.1 The shipping cost is automatically calculated at checkout.

8.2 The cost may vary depending on:

  • Weight;

  • Volume;

  • Destination;

  • Urgency;

  • Promotional campaigns;

  • Chosen carrier.

9. Right of Withdrawal (Cooling-off Period)

9.1 The consumer has a legal period of 14 days to freely withdraw from the distance contract, in accordance with Decree-Law no. 24/2014.

9.2 The period is counted from the date of physical receipt of the goods.

9.3 To exercise the right of withdrawal, the customer must communicate their decision by an unequivocal statement sent to the contacts available on the website.

9.4 Following communication, the goods must be returned within the legally applicable period.

10. Exceptions to the Right of Withdrawal

10.1 Under legal terms, the right of withdrawal cannot be exercised, namely, regarding:

a) Sealed products opened after delivery Sealed products that are not suitable for return due to health protection or hygiene reasons when opened after delivery, including:

  • Creams;

  • Cosmetics;

  • Hygiene products;

  • Products for skin application;

  • Sealed products for children’s use.

b) Perishable products Goods liable to deteriorate or expire rapidly.

c) Personalized products Products made to consumer specifications.

10.2 Whenever the outer security packaging, tamper-evident seal, or seal has been breached, the return may be refused where legally permissible.

11. Condition of Returned Products

11.1 Without prejudice to the consumer’s legal rights, products returned under the right of withdrawal must be in an appropriate condition.

11.2 There may be a depreciation in the value of the good when it is objectively demonstrated that the good was handled beyond what was necessary to establish its nature, characteristics, and functioning.

12. Non-Conforming / Defective Products

12.1 If the customer receives a product that is damaged, exchanged, deteriorated, leaking, has compromised packaging, or is different from the one ordered, they should contact Aleo Cosmética as soon as possible.

12.2 Whenever possible, the following should be sent:

  • Order number;

  • Photographs of the outer packaging;

  • Photographs of the product;

  • Description of the problem.

12.3 Once the non-conformity is confirmed, a legally appropriate solution will be proposed, namely replacement, refund, price reduction, or another agreed solution.

13. Liability

13.1 Aleo Cosmética is not liable for damages resulting from:

  • Use contrary to instructions;

  • Misuse;

  • Inadequate storage;

  • Individual/allergic reactions not previously known;

  • Use after the expiration date;

  • Combination with other products.

13.2 In case of irritation or adverse reaction, use must be discontinued.

14. Copyright and Industrial Property

14.1 All content existing on the website, including texts, images, photographs, logos, trademarks, graphic design, visual elements, trade names, packaging, and other materials, is protected by copyright and/or industrial property rights, under applicable legal terms.

14.2 Any total or partial reproduction, use, distribution, modification, or exploitation without prior written authorization from Aleo Cosmética, Lda. is prohibited.

15. Protection of Personal Data

15.1 The processing of personal data is governed by the Privacy Policy available on the website.

15.2 The website may use cookies, in accordance with its respective Cookie Policy.

16. Alternative Dispute Resolution (ADR)

16.1 In the event of a consumer dispute, the consumer may resort to a legally competent alternative dispute resolution entity.

16.2 Additional information is available on the Consumer Portal (Portal do Consumidor).

17. Applicable Law

17.1 The resolution of any dispute arising from the application and interpretation of these General Terms and Conditions of Online Sale, including their validity, the use of the website, or any purchase made on it, shall be governed by Portuguese Law, namely Decree-Law no. 24/2014, of February 14, in its most recent wording given by Law no. 10/2023, of March 03, among other applicable legislation.

17.2 Without prejudice to the provisions of the preceding paragraph, in the event of a dispute, the customer may, under and for the purposes of the provisions of Article 18 of Law no. 144/2015, of September 8, amended by Decree-Law no. 102/2017, of August 23, resort to the following Alternative Dispute Resolution (ADR) Entity:

18. Amendments to the Terms

18.1 Aleo Cosmética may amend these General Conditions at any time.
